关于对刘某、谢某犯强奸罪申诉案件复查情况的通报

line-height: 1.75; margin-bottom: 20px; margin-left: 0px; margin-right: 0px; margin-top: 20px; padding: 0px; text-align: justify; text-indent: 0px\"\u003e\u003cspan style=\"letter-spacing: normal\"\u003e\u003cspan style=\"font-size: 18px\"\u003e\u003cspan style=\"color: rgb(34, 34, 34)\"\u003e\u003cspan style=\"background-color: rgb(255, 255, 255)\"\u003e2010年8月19日，湖南省娄底市中级人民法院一审对被告人刘某（1992年9月出生）、被告人谢某（1992年9月出生）犯强奸罪判处无期徒刑，剥夺政治权利终身。2010年12月8日，我院二审作出刑事附带民事裁定，驳回上诉，维持原判。判决生效后，余某云（谢某之母）、刘某洞（刘某之父）不服，提出申诉。我院于2012年12月7日驳回申诉。余某云、刘某洞仍不服，向湖南省人民检察院提出申诉，湖南省人民检察院于2014年12月7日作出刑事复查通知书，决定不予提请抗诉。2015年7月16日，谢某东（谢某之父）向最高人民检察院申诉，最高人民检察院审查后认为一、二审认定事实清楚，证据确实、充分，定罪准确，量刑适当，于2016年7月8日驳回申诉。后谢某、刘某、许某红（刘某之母）、谢某东仍不服，继续申诉。我院经审查认为，原审认定事实清楚，证据确实、充分，定罪准确，量刑适当，审判程序合法，申诉理由不能成立，不符合《中华人民共和国刑事诉讼法》第二百五十三条规定的重新审判条件。据此，我院予以驳回。\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c!--MID_AD_0--\u003e\u003c!--EOP_0--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_0--\u003e\u003cp style=\"background-color: rgb(255, 255, 255); line-height: 1.75; margin-bottom: 20px; margin-left: 0px; margin-right: 0px; margin-top: 20px; padding: 0px; text-align: justify; text-indent: 0px\"\u003e\u003cspan style=\"letter-spacing: normal\"\u003e\u003cspan style=\"font-size: 18px\"\u003e\u003cspan style=\"color: rgb(34, 34, 34)\"\u003e\u003cspan style=\"background-color: rgb(255, 255, 255)\"\u003e法院经审理查明，2009年8月25日19时许，被告人刘某、谢某在冷水江制碱厂一生活区门球场边看过手机上的淫秽视频后，约定一起去强奸晚上经常在11栋楼顶散步的被害人刘甲（化名），并先到14栋楼顶确认刘甲正独自在11栋楼顶散步。刘某和谢某来到11栋楼顶后，趁刘甲不备，用木棒、拳头将其打晕，准备强奸时见其动弹，又再次殴打。随后，二人先后强奸了刘甲，并将作案用的木棒丢弃在冷水江市博大医院旁边的猪舍附近。当晚，刘甲被送医后抢救无效死亡。法医学尸体检验鉴定认为，刘甲系钝器致伤导致呼吸、循环衰竭死亡。\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e\u003cp style=\"background-color: rgb(255, 255, 255); line-height: 1.75; margin-bottom: 20px; margin-left: 0px; margin-right: 0px; margin-top: 20px; padding: 0px; text-align: justify; text-indent: 0px\"\u003e\u003cspan style=\"letter-spacing: normal\"\u003e\u003cspan style=\"font-size: 18px\"\u003e\u003cspan style=\"color: rgb(34, 34, 34)\"\u003e\u003cspan style=\"background-color: rgb(255, 255, 255)\"\u003e8月29日，刘某、谢某到案后，除供述了强奸案犯罪事实外，同时供述了许某红、谢某东、余某云教唆两人虚构事实、作假证包庇的犯罪事实。8月30日，许某红、谢某东到案后，分别作出有罪供述。许某红供述，案发当晚，刘某告诉她其强奸了一女的。次日，当她得知刘甲被杀后追问刘某，刘某遂告知了自己和谢某强奸刘甲的事实，她要求刘某不要承认并虚构当天的活动情况。谢某东供述，谢某在案发次日告知他，自己和刘某看了淫秽视频后，强奸刘甲时无意中把其打死。于是，他要谢某将8月25日活动情况和电视节目按时间顺序背熟，以应对公安机关的调查。余某云因抚养幼子，公安机关未对其采取强制措施，2010年2月2日余某云投案自首，作出包庇谢某犯罪的有罪供述。\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\u003cp style=\"background-color: rgb(255, 255, 255);
